Please read these Terms and Conditions ("Terms", "Terms and Conditions") carefully before using the cEngine website and data enrichment services (the "Service") operated by cEngine ("us", "we", "our").

1. Acceptance of Terms

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Service.

2. Description of Service

cEngine provides data enrichment services using publicly available Open Source Intelligence (OSINT) data. The Service is provided "as is" and "as available" basis.

2.1 Data Accuracy Disclaimer

  • We do not guarantee the accuracy, completeness, or timeliness of any data provided through our Service
  • The enriched data may not always be up-to-date as public information sources are updated at varying intervals
  • Results may vary depending on the availability of public information
  • Users should independently verify any critical information before making business decisions
  • We are not responsible for any actions taken based on the enriched data provided

3. User Obligations

By using our Service, you agree to:

  • Provide accurate and complete information when creating an account
  • Maintain the security of your account credentials
  • Use the Service in compliance with all applicable laws and regulations
  • Not attempt to bypass or manipulate our systems or pricing
  • Not use our Service for any illegal or unauthorized purpose
  • Obtain all necessary consents and permissions for processing customer data

3.1 Data Usage Requirements

  • You have the legal right to process the customer data you submit
  • You have obtained all necessary consents from your customers
  • Your use of our Service complies with applicable privacy laws and regulations
  • You will not submit any illegally obtained data or data from breached databases

4. Credits and Payments

4.1 Credit System

  • Our Service operates on a credit-based pricing model
  • One (1) credit is consumed for each email address or phone number successfully processed
  • A credit is consumed even when no additional data is found for a submitted email/phone number, as our system still performs the search and consumes resources
  • Credits must be purchased in advance of using the Service
  • Purchased credits expire after 6 months from the date of purchase
  • Credits are non-transferable and non-shareable between accounts

4.2 Pricing and Payment

  • All credit package prices are subject to change with notice
  • Changes in pricing will not affect already purchased credits
  • You agree to pay all charges associated with credit purchases
  • All fees are exclusive of applicable taxes
  • We may offer different credit package sizes with varying per-credit rates
  • Volume discounts, if available, are subject to our discretion

4.3 Refund Policy

  • Refunds are ONLY eligible if you have not gained access to the Service after payment
  • Once you have accessed the Service or consumed any credits, no refunds will be provided
  • Unused credits are non-refundable
  • Partially used credit packages are non-refundable
  • Refund requests must be submitted within 48 hours of purchase if access was not provided
  • All refund requests must be sent to contact[at]cengine.app

4.4 Account Termination

  • We reserve the right to terminate accounts for violation of these Terms
  • Upon account termination:
    • Any unused credits will be forfeited
    • No refunds will be provided for unused credits
    • You will lose access to all previously enriched data

4.5 Credit Usage and Processing

  • Credits are deducted only upon successful processing of submitted data
  • Credits are consumed when:
    • The enrichment process completes successfully, regardless of whether additional data is found
    • The submitted email/phone number is valid and processable
  • Credits are NOT consumed when:
    • Technical errors occur during processing
    • The enrichment process fails to complete
    • The submitted data is invalid or improperly formatted
  • You are responsible for monitoring your credit balance
  • The Service may be automatically suspended when you run out of credits
  • You may purchase additional credits at any time to continue using the Service

5. Data Processing and Privacy

5.1 Data Processing Terms

  • We act as a data processor for your submitted customer data
  • You remain the data controller for all customer data
  • We process data according to our Privacy Policy
  • We implement appropriate technical and organizational security measures

5.2 Data Retention

  • Data retention periods are specified in our Privacy Policy
  • You can delete your data through the dashboard at any time
  • We may retain certain data as required by law

6. Intellectual Property

6.1 Our Intellectual Property

  • All Service-related intellectual property belongs to cEngine
  • You may not copy, modify, or create derivative works
  • You may not reverse engineer the Service

6.2 Your Data

  • You retain all rights to your customer data
  • You grant us limited license to process your data for service provision

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND
  • WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
  • OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE SERVICE IN THE PAST 12 MONTHS
  • WE ARE NOT LIABLE FOR:
    • ACCURACY OF ENRICHED DATA
    • TIMELINESS OF INFORMATION
    • BUSINESS DECISIONS MADE USING OUR SERVICE
    • SERVICE INTERRUPTIONS
    • DATA LOSS OR CORRUPTION
    • THIRD-PARTY SERVICES OR LINKS

8. Indemnification

You agree to indemnify and hold harmless cEngine and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Your customer data and its processing

9. Service Modifications

We reserve the right to:

  • Modify or discontinue any part of the Service
  • Change pricing with notice
  • Update these Terms at any time
  • Refuse service to anyone for any reason

10. Force Majeure

We are not liable for any failure or delay in performance due to circumstances beyond our reasonable control.

11. Geographic Restrictions

We make no representations that the Service is appropriate or available for use in all locations.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Saudi Arabia, without regard to its conflict of law provisions.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the new Terms on this page and updating the "last updated" date.
